1.1 Acceptance of the Contract
By booking services with Pachamama Escapes (hereinafter, “the Agency”), the client (hereinafter, “the Traveler”) expressly accepts these Terms and Conditions. This acceptance has the same legal validity as a physical signature, in accordance with e-commerce regulations in Peru and other jurisdictions.
Acceptance occurs when the Traveler:
- Makes a reservation through the website, email, WhatsApp, or any official channel.
- Makes any payment, full or partial.
- Browses the website and submits forms.
1.2 Purpose of the Service
Pachamama Escapes provides tourism services including day tours, multi-day packages, tourist transportation, professional guides, accommodation (when specified), entrance tickets, meals, and pre-trip advisory.
Each service is described on our website, in personalized quotes, or in technical sheets shared with the Traveler.
1.3 Reservation Process and Payments
- A reservation is only confirmed when:
- The Traveler provides all required information.
- At least 50% of the total service cost has been paid.
- The Agency issues written confirmation.
- Accepted payment methods: international credit/debit cards (Visa, Mastercard, Amex), bank transfers, secure payment gateways (Stripe, PayPal), or other authorized methods.
The Traveler is responsible for any bank fees or international transfer charges.
1.4 Service Modifications
The Agency may reasonably adjust itineraries or logistics due to operational or safety reasons, including:
- Changes in departure or return schedules.
- Replacement of guides, transport, or local providers.
- Adjustments in the order of visits.
No compensation will apply if the core essence of the service is maintained.
1.5 Responsibilities and Liability Waiver
The Traveler acknowledges that activities may involve exposure to unpredictable natural conditions (altitude, weather, wildlife, etc.). Participation is voluntary and at the Traveler’s own risk.
The Agency is not responsible for:
- Accidents caused by Traveler negligence.
- Loss of personal belongings.
- Delays caused by third parties (airlines, trains, hotels).
- Physical discomfort related to altitude, weather, or lack of preparation.
Travelers are strongly advised to purchase international travel insurance.
1.6 Health Conditions
By booking, the Traveler certifies being in adequate physical and mental condition. Any medical condition, dietary restriction, or special requirement must be disclosed in advance in writing.
1.7 Use of Images
During tours, photos and videos may be taken. By booking, the Traveler authorizes their free use for promotional purposes, unless explicitly denied in writing before the service begins.
1.8 Governing Law and Jurisdiction
This contract is governed by Peruvian law. Any disputes shall be resolved by the competent courts in Cusco, Peru.
